Thailand plans to buy more generic AIDS drugs from India to cut the cost of treating its poorest patients after failing to win large enough discounts from drug makers including Merck & Co. and Abbott Laboratories…Public health minister, Mongkol Na Songkhla, said…“If their prices aren’t more than 5% above the generic drugs, we won’t hesitate to buy from them. Now, their prices are 20% higher.”…Thailand’s Food and Drug Administration director-general Siriwat Thiptharadol, is meeting “about twice a week” with pharmaceutical companies to continue price negotiations…[also refers to Matrix Laboratories, Sanofi-Aventis]

Under the drug regulatory process any drug, whether patented or not, must pass safety, efficacy and quality tests for marketing from the Drug Controller-General of India (DGCI)...the DGCI can [currently] rely on previous test data to approve subsequent generic versions of the same drug. This allows generic drug manufacturers to circumvent expensive repeats of clinical trials that translate into cheap and quick drug availability in the market. But in 2005, the powerful Pharmaceutical Research and Manufacturers of America, (PhRMA) lobbied the United States Trade Representative to impose data exclusivity on drug trial submissions...Public health groups...protest...that this is yet another move by MNCs to monopolise the drug market in India, to the detriment of public health and the market for essential generic drugs [refers to PhRMA members Novartis, Pfizer, GlaxoSmithKline, Merck]

In the fall of 2003, Abbott Laboratories...seized on an unusual weapon that helped [its AIDS drug] Kaletra's global sales top $1 billion a year, even as it exposed Abbott to criticism that it was endangering patients. The weapon was an older Abbott AIDS drug called Norvir. It is a key part of drug regimens that include rival companies' pills. Previously undisclosed documents and emails reviewed by The Wall Street Journal show how Abbott executives discussed ways to diminish the attraction of Norvir, with the goal of forcing patients to drop the rival drugs and turn to Kaletra...The executives expected a Norvir price hike would help Kaletra sales...[Initial criticisms] that the price hike made it harder for patients who needed drug combinations pairing Norvir with non-Abbott pills to get their medicine...[did fade], partly because Abbott exempted government health plans and AIDS drug-assistance programs from the Norvir price increase... An Abbott spokeswoman, Melissa Brotz, says...the price increase was intended to better reflect Norvir's medical value after years of being underestimated..."Our intention was that no patient be denied access to Norvir," she says.

When the drug industry came under fire last summer for failing to disclose poor results from studies of antidepressants, major drug makers promised to provide more information about their research on new medicines...Eli Lilly and some other companies have posted hundreds of trial results on the Web and pledged to disclose all results for all drugs they sell. But other drug makers, including Merck and Pfizer, release less information and are reluctant to add more, citing competitive pressures...the major drug companies in January agreed to expand the number of trials registered on clinicaltrials.gov...But Merck, Pfizer and GlaxoSmithKline, three of the six largest drug companies, have met the letter but not the spirit of that agreement, Dr. Zarin [Deborah Zarin, director of clinicaltrials.gov] said...Pfizer, Merck and GlaxoSmithKline say that they disclose their largest trials, which determine whether a drug will be approved...Rick Koenig, a spokesman for Glaxo, said the company understood the concerns about disclosure and planned to add more information to clinicaltrials.gov. The following is a comment on two reports being circulated by the pharmaceutical industry regarding the importance of patents in Africa as a barrier to treatment for AIDS...The assertion in both documents is that patents are not an important barrier for access to antiretroviral drugs in African countries, while poverty and limited public and donor spending on health care are important barriers. These are long time industry talking points...The question is, how important are the patents on these 150 to 172 drugs or combinations of drugs. According AGW and PhRMA, they are not important. According to NGOs working on the access to medicines campaign, they are important barriers.
