In a ruling of potential interest for older workers across the country, the Supreme Court made it easier for workers to contend that they are being discriminated against by their employers because of their age…[T]he court ruled that it is up to the employer to show that action against a worker stems from “reasonable factors other than age.” The question in the case…was whether the burden rested on the employer or on an employee bringing a suit. Justice Souter wrote [that] the language of the Age Discrimination in Employment Act of 1967 makes it clear that Congress wanted the burden to be on the employer. A Morris County, N.J., jury has returned a $10 million punitive damages verdict in an age discrimination suit against Avaya Inc. of Basking Ridge, N.J. Tuesday's verdict, believed to be a record in New Jersey in an age bias case, came a day after the jury awarded $743,000 in compensatory damages to Nicholas Saffos of Yorktown Heights, N.Y…. Saffos alleged that his termination as business relationship manager in Avaya's real estate department…was part of a purge of older workers... [C]ompany spokeswoman Lynn Newman...[said] "we do not believe there is any basis for this type of award" and that Avaya is considering its options, including an appeal.

Black workers currently and formerly employed by TCF Bank in the metropolitan Detroit metropolitan area say that the bank has systematically discriminated against them because of their race and age...Attorney Felicia Duncan has filed suit in Wayne County Circuit Court against [TCF]...on behalf of three workers, and expects to file more individual suits in the near future.

American workers who complain about race or age discrimination on the job can sue their bosses for any subsequent retaliation. In two decisions announced on Tuesday, the US Supreme Court embraced an expansive view of certain civil rights laws that do not explicitly outlaw acts of retaliation. Nonetheless, the majority justices said the overall purpose of the laws suggests an intent by Congress to prevent discrimination – including retaliation aimed at punishing those who file age- or race-discrimination complaints…The majority justices ruled that employees can claim legal protections against retaliation even if the law does not specifically bar acts of retaliation. The U.S. Equal Employment Opportunity Commission (EEOC) received a total of 82,792 private sector discrimination complaints in fiscal year 2007, the highest volume of incoming charges since 2002 and the largest annual increase (9 percent) since the early 1990s, the agency reported... According to the EEOC's data for fiscal year 2007, allegations of discrimination based on race, retaliation, and sex were the most frequently filed charges, continuing a long-term trend. Additionally, nearly all major charge categories showed double digit percentage increases from the prior year--a rare occurrence...
A 19-year-old woman who claimed that she was sacked for being too young has been awarded more than £16,000 in compensation after winning a ground-breaking case against her former employer...Leanne Wilkinson, who was then 18, claimed that she suffered age discrimination when she was dismissed from her job as an administrative assistant at Springwell Engineering in Newcastle upon Tyne. She claimed the company had told her that she was too young for the post and that they needed an older person with more experience. An employment tribunal ruled in her favour, concluding that she had been discriminated against on the grounds of age.
