"US to develop Business and Human Rights National Action Plan", Oct 2014

At this point, it is difficult to forecast the content of the US National Action Plan.  Based on the early adopters, though, it may contain a plan to implement legislation that requires businesses to report on how they respect human rights in their operations (similar to certain requirements of the Dodd-Frank Act, the Burma Responsible Investment Reporting Requirements, and the California Transparency in the Supply Chain Act).  It may also contain initiatives to more strongly protect human rights in government contracting (similar to Executive Order – Strengthening Protections Against Trafficking In Persons In Federal Contracts).  And, it may articulate reforms designed to increase access to US courts for plaintiffs from outside the US, in response to Kiobel.  Whatever the case, we will provide updates as the US National Action Plan process unfolds.
