Case No. 180/1965/24 2/180/765/24 Decision in the name of Ukraine, 1 November 2024

An individual (referred to as PERSON_1), represented by attorney Olena Vasylivna Povaliy, filed a lawsuit against JSC Marhanets Mining and Processing Plant seeking compensation for moral damages due to health impairment sustained while working at the company. He developed several chronic occupational diseases, as documented in Investigation Act Form P-4 dated February 6, 2023. According to a Medical and Social Expert Commission (MSEC) evaluation on April 13, 2023, he was found to have 65% loss of professional working capacity and was classified as a Group 3 disabled person for life.

The claimant argued that the company failed to provide safe working conditions, which led to the deterioration of his health and caused moral suffering due to ongoing medical treatment, physical pain, and frequent examinations. He sought 245,000 UAH in moral damages.

The court partially upheld the claim. It ordered JSC Marhanets Mining and Processing Plant to pay 130,000 UAH in moral damages to PERSON_1, subject to applicable taxes and fees as per Ukrainian law.
