Response to request for feedback on PT Kizone case in Indonesia

The basic facts of the PT Kizone case were outlined in an earlier response to BHRRC. Please see our letter of 12 May, 2012…We do not agree with WRC’s general thesis that under collegiate licensing agreements a licensor is obliged to remedy labour non-compliances by assuming the legal responsibilities of its contracted suppliers…In the cases of business insolvency and bankruptcies, such as at PT Kizone, the payment of severance in Indonesia is managed through a Court-appointed receiver and is a matter for the Commercial Court to decide, not a brand. Where a brand can help, is by raising concerns with government regarding the behaviour of business owners who do not act responsibly. This we have done. Brands can also offer humanitarian aid or relief to workers. This we have done. And finally by addressing the systemic issues that lie behind cases such as PT Kizone…This we are doing.
