Japan: Court orders restaurant to pay 6,800 yen as claimed after last-minute cancellation of one-off “spot work” shift ruled unfair

In a case involving short-term, one-off “spot work” jobs, a university student living in Kanagawa Prefecture used an app to secure a matched job, only for it to be cancelled the day before the scheduled shift. Claiming that the last-minute cancellation by the restaurant was unjust, the student filed a lawsuit seeking payment of unpaid wages and related compensation. The Tokyo Summary Court ordered the restaurant to pay ¥6,800 (32 pounds) as claimed. The restaurant did not appear in court and did not contest the case.

The student’s attorney, Hiroki Makino, said, “This may be the first court ruling to address responsibility for last-minute cancellations in spot work,” adding that “not only the restaurant, but also the platform providers offering the matching systems should take this ruling seriously.”
