La FIDH se félicite du fait que le projet de loi crée une obligation de vigilance pour les entreprises, visant à identifier et remédier aux atteintes aux droits humains et à l’environnement dans leurs chaînes de valeur mondiales. Néanmoins, le texte suggère que ces obligations pourraient être remplies en se reposant sur des codes de conduite internes aux entreprises, des clauses contractuelles entre une entreprise et ses fournisseurs ou partenaires commerciaux, des systèmes d’audit et de vérification et des initiatives sectorielles - des mécanismes déjà existants et qui ont largement échoué à protéger les droits humains et l’environnement. Une telle approche, fondée explicitement sur la compliance (conformité) en matière de vigilance, pourrait permettre aux sociétés mères de se déresponsabiliser sur ses partenaires commerciaux, et risque d’affaiblir l’ensemble du texte.
Le champ d’application de la directive proposée est également décevant. Elle s’appliquerait aux entreprises opérant sur le marché européen avec plus de 500 employé.es et 150 millions d’euros de chiffre d’affaires. Dans certains secteurs « à fort impact » comme les mines et la sylviculture, le texte adopte des seuils inférieurs : 250 employé.es et 40 millions d’euros de chiffre d’affaires...
...[L]es mesures de protection du climat prévues par le projet sont faibles : si les entreprises seront tenues d’adopter un plan de transition climatique conforme à l’accord de Paris, elles ne pourront être tenues responsables si elles ne le mettent pas en oeuvre.
Élément positif, la directive permet d’établir la responsabilité civile des entreprises en cas de dommages commis par elles ou des entités de leur chaîne de valeur. Elle permet aussi à des autorités de contrôle de sanctionner les entreprises qui ne respectent pas leurs obligations. Cependant, la directive n’aborde pas les principaux obstacles à l’accès des victimes aux recours : coûts élevés des contentieux, charge de la preuve disproportionnée, opacité et manque d’accès à l’information, règles restrictives sur l’intérêt à agir et délais de prescription limités...
