Statkraft's response to arbitrary arrests of Mapuche Williche defenders
...Statkraft welcomes the inquiry from the Business and Human Rights Resource Centre (BHRRC) in relation to the detentions of Felipe Trunci González and Jaime Javier Uribe Montiel (both referred to in the information shared with Statkraft by BHRRC). Statkraft is grateful to BHRRC for the opportunity to respond.
Respect for human rights is a fundamental principle within our Code of Conduct. This includes an explicit commitment to respecting the rights of Indigenous Peoples where they are affected by our activities.
Statkraft also respects the rights of human rights defenders to free expression, peaceful assembly and equal protection under the law. We acknowledge that human rights defenders are entitled to take every lawful opportunity to advocate for the promotion, protection and enforcement of human rights. Statkraft expects States to take necessary measures to ensure that human rights defenders are not subject to intimidation, harassment, violence or retaliation.
In relation to Mr. Trunci González and Mr. Uribe Montiel, Statkraft would like to clarify that the decisions to detain these individuals were made independently by the police. Statkraft has neither influenced nor been involved in the decision-making process regarding these detentions and has no further insight into these matters.
Statkraft would also like to draw attention to the comments of the Norwegian OECD National Contact Point (NCP), in its initial assessment in relation to the 2023 complaint against Statkraft from certain Mapuche-Williche communities. The NCP noted that there was no evidence to “indicate that Statkraft AS is responsible for or linked to breaches of the rights of human rights defenders allegedly inflicted by the police or other official bodies”.
