In May 2024, the plaintiff (PERSON_2) filed a lawsuit against the defendant, PJSC Tsentralny Mining and Processing Plant, seeking compensation for moral damages caused by health impairment resulting from the performance of job duties.

According to a medical board certificate dated April 16, 2024, the plaintiff was assigned disability group 3 and diagnosed with a 65% loss of professional working capacity.

The plaintiff claimed that due to the employer’s failure to ensure safe working conditions, he lost his health, resulting in moral suffering, including:

constant physical pain,

disruption of his normal lifestyle,

need for additional effort to manage everyday life,

and social limitations due to the inability to lead an active life.

The court partially satisfied the claim.

The court ordered PJSC Tsentralny Mining and Processing Plant to pay ₴225,000 (two hundred twenty-five thousand UAH) in moral damages to PERSON_2, without withholding income tax.
