USA: New York City files lawsuit against platform delivery co. Motoclick for alleged wage violations; incl. co. comment
In January 2026, it was reported that New York City has filed a lawsuit against the platform delivery company Motoclick for allegedly failing to pay the city’s minimum wage and subjecting workers to wage violations, including fining workers for cancelled orders.
In reporting by The Nation, a Guatemalan worker working on the Motoclick app says he was paid USD6.75 for three hours work in November 2024 – the minimum age rate was USD19.56 per hour at the time, according to the article. He and twenty other workers reportedly filed complaints with the city administration, which in turn filed the lawsuit.
Reporting on the case also highlights that the city’s Department of Consumer and Worker Protection released a report in January that found DoorDash and Uber changed their apps in December 2023 to make tipping harder for customers. The report estimates the changed tipping process may have deprived gig worekrs of USD550million since December 2023.
New worker protections on tipping are set to take effect in January 2026; DoorDash and Uber have sued to block the tipping law.
DoorDash said in a statement that workers are earning more overall even with lower tips and customers are choosing to tip less. Uber did not respond to requests for comment from Business Insider Africa. The Nation invited Motoclick to comment but did not receive a response.
