Manzanarez v. C&Y Sportswear, Nien Hsing Textile Co., Ltd. and Chentex Garments

In December, 2000, CCR filed suit against the [Nicaraguan] factory, Chentex Garments, Nien Hsing, its [Taiwanese] parent company, and its U.S. subsidiary, on behalf of four union leaders fired by Chentex. The suit was filed under the Alien Tort Claims Act, and alleges that Chentex and Nien Hsing violated internationally recognized labor rights, including the right to organize and to free assembly. This is the first suit brought under ATCA that alleges that union busting and other anti-labor practices violate the “Law of Nations” that serves as the basis for the Act.
