Prof Surya Deva appointed to UN Working Group on Business & Human Rights
Professor Surya Deva has been appointed as the Asia-Pacific representative of the United Nations Working Group on the issue of human rights and transnational corporations and other business enterprises. Deva is an Associate Professor at the School of Law of City University of Hong Kong. His primary research interests lie in Business and Human Rights, Corporate Social Responsibility, India-China Constitutional Law, and Sustainable Development. He has published extensively in these areas. Deva recently wrote a background paper for India’s National Framework on Business and Human Rights. He is one of the founding Editors-in-Chief of the Business and Human Rights Journal, and sits on the Editorial Board of the Netherlands Quarterly of Human Rights. In 2014, Deva was elected a Member of the Executive Committee of the International Association of Constitutional Law.

As far as the Working Group on on the issue of human rights and transnational corporations and other business enterprises is concerned, during my consultations questons were raised to the ability, or willingness of the proposed candidate ranked first to comply with the mandate of the Working Group. The candidate confirmed in a telephonic conversation that he is fully aware of and committed to upholding the manadate of the Working Group and would not in any way undermine its work. Based on this clarification, i have decided to follow the recommendtaion of the Consultative Group and propsoe Mr Surya DEVA (India) as the new member of the Working Group. I also took careful note of the concerns raised in relation to the gender balance within the Workign Group.

...This paper examines two broad questions: first, whether India needs a BHR framework at the national level to implement the GPs; second, assuming that such a framework is needed, what the content of such a framework should be and what principles should be followed to make the process transparent, inclusive and legitimate...The GPs provide the Indian government an opportunity to assess its laws and policies that have a bearing on BHR and consider taking appropriate remedial steps. Doing so would ensure that India’s path of economic development is not only sustainable and inclusive but also free from social con icts. Developing a coherent BHR framework in a transparent and consultativemanner is one key tool that should assist in achieving this goal. The presence of a stable politico-economic system, vibrant democracy, free media, robust civil society, independent judiciary and the rule of law means that India already has the basic ingredients necessary to develop and sustain a BHR framework at national level
