Protecting the fight for business accountability: How the draft treaty can be improved to take into account the challenges faced by human rights defenders

The fourth session of the intergovernmental working group on transnational corporations and other business enterprises with respect to human rights marks a crucial point in the negotiations for a binding treaty on business and human rights. Four years after the start of the process, the publication of a draft convention and optional protocol provides a fresh opportunity to have concrete discussion on the content of the future international instrument. 

While the proposed draft has a specific focus on the rights of victims, many have observed that the it unfortunately does not contain any specific reference to human rights defenders and those defending or representing victims of violations, failing to acknowledge the particular risk of human rights abuses faced by human rights defenders, who are not only vulnerable to, but often the very target of corporate human rights abuses.

The side event will bring together defenders and NGOs that will speak about the key risks and challenges faced by HRDs, along with experts that will explain how the wording of the treaty can be modified to better protect defenders.
