The ATS [Alien Tort Statute] is an American statute. There is no identical provision in Dutch law but nevertheless private actors, including both individuals and corporate entities, may incur criminal liability as well as civil liability in the Netherlands for their involvement in international human rights violations perpetrated abroad. Dutch courts would recognize and have in fact recognized claims similar to those pursued by the Petitioners here.
