Relatives of victims and representatives respond to Engie’s statement regarding alleged harm caused by natural gas explosions

Alegações

The BHRC invited representatives and relatives of the victims to comment on Engie’s response to the allegations of alleged harm caused by explosions related to natural gas facilities, to which the families and representatives replied (english translation made by the BHRC):

...

Subject: Response regarding ENGIE Mexico’s explosions and negligence

In relation to the multiple instances of negligence reported by various media outlets, as well as the tragic deaths of four young people —Jair, José, Ana, and Alonso— in addition to the injuries and material damages resulting from several explosions and leaks in the natural gas network operated by ENGIE in Mexican territory, we state the following...

To date, in all recorded cases, the cause of the explosions has been attributed to natural gas from ENGIE’s network.

...

So far, the cases remain ongoing. ENGIE and its subsidiaries continue under investigation and, in some cases, as defendants awaiting resolution...

In the case of the June 2023 explosion, ENGIE notified Thalía’s family that it would suspend all communication, conditioning it on the presentation of evidence that is already in the possession of the investigative authorities, leaving any approach unanswered for months.

Meetings between Thalía’s family and ENGIE’s legal representatives revealed that, far from providing empathy and support, they received threats, corporate gaslighting, re-victimization, and intimidation, both privately and publicly...

Background: On January 25, 2022, there was an explosion due to gas accumulation at a 7-Eleven store (7 Eleven México, S.A. de C.V.), in which its employee Jair Alexis Acatecatl Mendoza (Jair), 22 years old, suffered burns on 60% of his body. He was treated for 13 days, which were days of suffering for the young man and his family, and sadly Jair passed away. Prior to the explosion, there were countless calls warning Tamauligas, 7-Eleven, and the authorities about the imminent smell of gas, which were not addressed. Had they been attended to, human losses could have been avoided.

Indeed, the defendant companies have failed to comply with their legal and contractual obligations, using delaying tactics that the court itself has allowed. Currently, since November 2024, the court has kept the trial suspended without justified cause, based on an alleged exception of extinction by payment that does not exist and is not grounds for suspension. The court has even been asked to cease hearing the case without issuing rulings in accordance with the law, continuing the trial without any legal basis, while other affected parties have had their damages repaired, but not Jair’s family, re-victimizing them through non-compliance and denying justice.

Request for support: Review the actual situation of Federal and Municipal permits in Tamaulipas, and:
a) Intervene so that the defendants comply with their obligations for full reparation of damages to Jair’s family.
b) Intervene so that the First Civil Court provides prompt and impartial justice, as it has illegally suspended the trial.
c) Intervene so that the Tamaulipas State Prosecutor’s Office ensures expedited justice.
