Petitioner, Pfizer Inc. ("Pfizer"), respectfully petitions for a writ of certiorari to review the judgment of the United States Court of Appeals for the Second Circuit in this case…In the decision below, the Second Circuit dramatically expanded ATS jurisdiction by allowing two complaints to proceed against an American corporation for conducting a clinical trial of an antibiotic medication in Nigeria, allegedly without obtaining adequate consent as required by international law…The Second Circuit also created two circuit conflicts…This Court should grant certiorari to resolve these conflicts and to give much needed guidance to the lower courts in the application of Sosa to ATS lawsuits against American corporations that do business abroad.
