A leading NGO in Niger, Réseau des Organisations pour la transparence et l'Analyse Budgétaire (Network of Organizations for Transparency and Budgetary Analysis, or ROTAB) published a "baseline study" on Business and Human Rights: The case of extractive industries in Niger (dated December 2014); it was widely disseminated in April 2015 through a launch in Niger and internationally by the Danish Institute for Human Rights.  

Business & Human Rights Resource Centre invited the principal companies named in the report that had not yet responded to the allegations it contained: China National Petroleum Corp. (CNPC), Somina (Société des Mines d'Azelik, joint venture of CNNC International, Sopamin [owned by Niger Govt.], ZXJoy Invest [Zhongxing Joy Investment], Korea Resources Corp.), Sonichar (Société nigérienne du charbon) and Sopamin (current owner of Société des Mines du Liptako).  

We also translated the Executive Summary of the report, and key portions concerning Somina and CNPC's affiliates in Niger into English.  The full report (in French only), the English translation of key sections, and Somina and Sopamin's responses are below.  Sonichar and CNPC have not responded.

We regret to read the reporting on the negative effects of SOMINA’s mining activities on the environment and the social development and believe that many accusations are groundless and one-sided, failing to reflect the real picture of SOMINA’s mining operations. Therefore, we feel there is a need to make some clarifications on certain points raised in the ROTAB report...SOMINA has complied with the Mining Agreement signed with the Niger Government and has fulfilled its obligations in the areas of environmental protection and social development. Sticking to the principle of minimising impacts of mining on the environment, SOMINA has taken active measures to reduce the production of solid, gas and liquid waste, protect employees’ health in the workplace, and monitor the environment in the mining zone and nearby areas to effectively prevent environmental pollution...

我们非常遗憾的看到ROTAB报告关于SOMINA的矿业活动对环境保护和社会发展的负面报道,认为很多指责是没有依据的、片面的,并未真实地反映SOMINA的客观实际情况,因此有必要对ROTAB报告中所提的一些方面予以澄清...一直努力遵守SOMINA与尼日尔政府之间签署的“矿业协议”,履行我们在环境保护和社会发展方面的义务。SOMINA按照“使矿业活动对环境影响最小化”的原则,采取积极的措施减少固体气体液体废物的排放,开展员工职业健康防护,进行矿区和周边环境监测,有效地防止环境污染事故发生。近几年来,尼日尔政府和阿加德兹大区每年都派出检查团进行2-3次的现场环保检查,SOMINA积极配合检查,提交年度环境管理报告,也尽最大努力对检查团提出的环境保护方面的不足进行改进,不管是完善环保设施还是改进监测管理都取得了不断进步。ROTAB报告指责SOMINA不遵守尼日尔环境保护规定,漠视尼日尔政府的环境保护改进意见,诋毁SOMINA没有履行环保责任和社会发展责任,这并不是事实...

Réponse de la SOPAMIN

Nous vous informons que la SOPAMIN n'est devenue opérateur minier que depuis un an avec le rachat de la mine de Samira Hill. Un état des lieux environnemental a été réalisé lors du processus d'achat. Ce travail a été réalisé par la Faculté des sciences de l'université Abdou Moumouni. Le département environnement et action communautaire de la SML gère le suivi environnemental au quotidien et produit des rapports mensuels qui sont transmis aux autorités. Par ailleurs, la SOPAMIN joue pour le compte de l'état du Niger un rôle de veille auprès des sociétés minières et donc nous sommes amenés à réaliser des audits et contrôles réguliers sur la protection de l'environnement, entre autres.

A new study sheds light on the serious human rights impacts that mining and oil industries have in Niger. Fumes, waste water and toxic material concern the local communities in the fragile West African state.  Economic growth is welcome in Niger... However, extractive industries might hurt local communities more than they contribute to progress.  That is the conclusion in a new baseline study that sheds light on a number of adverse human rights impacts of mining and oil industries in Niger by ROTAB, a coalition of civil society organisations in Niger. The team visited four different regions where uranium, gold and oil are being extracted. They met with affected community members and workers as well as with government and companies representatives... Nomadic shepherd communities are being particularly hurt when they lose access to land but they are not being compensated for the loss, as they hold no formal land titles.
