The two country visits were undertaken as part of the Special Rapporteur’s efforts to examine the effects on the enjoyment of human rights of the movement and dumping of toxic and dangerous products and wastes from the vessel Probo Koala [chartered by Trafigura], in Abidjan, on and around 19 August 2006...The Special Rapporteur considers that the due diligence test in the Probo Koala case rests on the questions of whether Trafigura took all the necessary precautions to prevent any possible adverse impact on human rights of the discharge of its waste, and of whether it could have reasonably known that its actions or omissions would contribute to a human rights violation.
