International law is not opposed to the Alien Tort Statute (ATS)…which allows U.S. courts to hear lawsuits for certain violations of international law on foreign soil. First, international law permits U.S. courts to recognize a cause of action for violations of the law of nations occurring within the territory of a sovereign other than the U.S. as long as a generally recognized basis of jurisdiction exists… Second, the prudential doctrine of international comity does not preclude the exercise of jurisdiction based upon the ATS… Third, any requirement under international law to exhaust local remedies does not categorically preclude a claim under the ATS.
