Wafler Farms, which has previously been linked to allegations of migrant rights abuse for alleged labour rights violations and using intimidation tactics to avoid negotiating with unions in 2023 and 2024, has now reportedly failed to follow the union contract that took effect in April. The contract was created through arbitration after the employer refused to bargain with the union. The union has filed a charge against Wafler Farms with the state Public Employment Relations Board for failing to follow the contract. The union also alleges that some workers were called back to the farm at a later point in retaliation for union organising. In October 2025, it was reported that Wafler Farms is still not following the union contract and has sued to overturn it - in July, a judge blocked the contract from taking effect while the suit proceeds. An article in New York Focus includes interviews with workers alleging poor working conditions on the farm, including 11-hour workdays, a machine that 'monitors' their work and notifies supervisors if they slow down, risks of inhaling pesticides, and 'deplorable' toilet conditions. Workers say they fear speaking up amid a 'culture of fear'. The workers also allegedly continue to work for a below-contract and without retirement benefits. The company disputes the claims.
