Ruling dated September 18, 2024, in case No. 215/2771/24, Dnipro Appellate Court

In April 2024, INDIVIDUAL_1 filed a lawsuit against the Private Joint-Stock Company Pivnichny Mining and Processing Plant (hereinafter referred to as PJSC Pivnichny GZK) seeking compensation for moral damages caused by health impairment.

The claim was based on the fact that, during her employment in harmful working conditions at PJSC Pivnichny GZK, the plaintiff developed two chronic occupational diseases. According to the conclusion of the State Institution "Ukrainian Research Institute of Industrial Medicine", these diseases resulted from prolonged exposure to harmful factors in the workplace.

As per a certificate issued by the Medical and Social Expert Commission (MSEC) dated April 23, 2024, the plaintiff was determined to have a 65% permanent loss of professional capacity due to the occupational diseases and was assigned a third-degree disability group.

By a decision of the Ternivskyi District Court of Kryvyi Rih, Dnipropetrovsk region, dated June 25, 2024, the claims of INDIVIDUAL_1 were partially satisfied.

The court ordered PJSC Pivnichny GZK to pay INDIVIDUAL_1 UAH 280,000 in moral damages, tax-free and without mandatory payments.
