A representative of the claimant, Shevtsova L.V., acting in the interests of PERSON_2, filed a claim against LLC “Yerystivsky Mining and Processing Plant” seeking UAH 200,000 in moral damages for health impairment caused by an occupational disease, as well as legal costs.

The court established that the claimant worked for the defendant from 29 March 2021 to 11 April 2024 as an assistant excavator operator in a quarry, after which he was dismissed due to health-related inability to perform his duties. During his employment, he developed multiple occupational diseases, including chronic bronchitis, pneumosclerosis with pulmonary insufficiency, sensorineural hearing loss, and stage II vibration disease, and was assessed as having a 70% loss of professional working capacity with a need for ongoing medical treatment.

The court partially upheld the claim, awarding UAH 150,000 in compensation for moral damages.
