Ukraine: Eastern Mining & Processing Plant ordered to pay UAH 200,000 in occupational disease compensation

The claimant, represented by attorney Oleksandr Motuz, filed a lawsuit through the ESITS “Electronic Court” system, seeking UAH 245,000 in compensation for moral damages caused by health impairment due to an occupational disease (without deductions for personal income tax or other mandatory payments).
The claim states that the claimant worked for a long period—from 18 September 1995 to 7 July 2006—in various positions across different structural units of the State Enterprise “Eastern Mining and Processing Plant.” On 7 July 2006, the claimant was dismissed. During employment, he developed a chronic occupational disease. A medical and social expert commission (MSEC) established a permanent 60% loss of working capacity and assigned him a third-degree disability.
The claimant argues that the illness has significantly disrupted his normal life, requiring ongoing treatment and causing constant physical pain, psychological distress, anxiety, irritability, fear, and sleep disturbances, which constitute moral suffering.
The court ruled:

- To award UAH 200,000 in moral damages without deductions for taxes or mandatory payments.
