法官在周二作出判决,纳米比亚矿业和能源部长无权吊销中国锂业公司的采矿许可证,吊销采矿许可证需通过法院。

鑫丰锂业有限公司在法院起诉纳米比亚矿业和能源部长汤姆·阿尔温多(Tom Alweendo)。阿尔温多在4月吊销了该公司的采矿许可证,并勒令公司在5月31日前停止开采作业。

鑫丰不服矿业和能源部长的决定,向纳米比亚高等法院提起诉讼,表示部长无权吊销此前由其本人作出的授予该公司采矿许可证的决定。

代理法官雷蒙·马斯多普(Ramon Maasdorp)判决,“根据相关法律,第一被告(矿业和能源部长)无明示或默示的权利吊销采矿许可证,吊销采矿许可证须诉诸法院。”

矿业和能源部长和鑫丰均没有立即就此发表评论。
