Vale’s response to delays in reparation and diversion of funds six years after Brumadinho

…We clarify that the Judicial Agreement for Full Reparations, signed on February 4, 2021,

established a series of payment obligations for Vale and the implementation of actions aimed at repairing all diffuse and collective socioeconomic damages resulting from the rupture of the Córrego do Feijão Dam. The participation of the community affected by the dam collapse was duly, actively, and legitimately represented by the Justice Institutions.

The conciliation and negotiation process for signing the agreement was conducted and

approved before the Court of Justice of the State of Minas Gerais and included not only the

participation of the Minas Gerais State Government, but also the effective, continuous, and

extensive participation of the State Public Defender's Office and the Federal and State Public

Prosecutors' Offices.

… The participation of affected communities is ensured in the Agreement through several

instruments: (i) “transparency and informed social participation of those affected, in accordance with Principle No. 10 of the United Nations Conference on Environment and Development; (ii) that “affected people will have informed participation assured in the conception, formulation,execution, monitoring, and evaluation of plans, programs, projects, and actions related to AnnexI…; (iii) that “affected people will act in the prioritization and monitoring of projects in Annexes I.3 and I.4.” and (iv) that “the process of participation of affected people may also occur through public hearings of the Legislative Assembly of Minas Gerais,” in addition to the guaranteed support of independent technical advisory - ATI, external audit, and broad access to information related to the implementation of the Agreement. Community participation was also guaranteed through a Popular Consultation held by the parties to prioritize demands for the implementation of socioeconomic reparation initiatives, as well as a Popular Consultation for Traditional Peoples and Communities. …the agreement signed for socioeconomic reparation in Brumadinho includes expanding

listening opportunities for communities, social organizations, and residents' associations. The participatory development of projects with communities seeks to listen to them and incorporate their expectations into the various reparation initiatives structured and implemented in the region. For these processes of listening, psychosocial support, and daily interaction, we rely on community relations teams comprised of multidisciplinary professionals to properly serve the entire affected population, including local communities, Indigenous peoples, and traditional communities…
