The requirement to obtain the free, prior and informed consent (FPIC) of indigenous peoples to activities and measures that may affect them, and/or the lands, territories and natural resources that they traditionally own, use or occupy, is one of the most contentious issues affecting interactions between public and private sector actors, on the one hand, and indigenous peoples...A recently published guide, “FPIC and the Extractive Industries: A guide to applying the spirit of free, prior and informed consent in industrial projects“, has the real potential to change the game regarding the application of FPIC from an antagonistic contest over legal interpretations of applicability and obligations, to a collaborative process to achieve a mutually acceptable accommodation of the parties respective interests, in the “sprit of FPIC”.
