Ukraine: Eastern Mining & Processing Plant ordered to pay UAH 200,000 to former Smolinska mine worker for occupational disease

The claimant filed a lawsuit against the State Enterprise “Eastern Mining and Processing Plant,” seeking UAH 250,000 in compensation for moral damages caused by loss of working capacity due to an occupational disease (without deductions for personal income tax).
The claim states that the claimant worked at the Smolinska mine of the enterprise from 7 April 2004 to 17 October 2016 in various positions across different structural units, including under hazardous working conditions. He was dismissed on 17 October 2016. During his employment, he developed a chronic occupational disease, which later resulted in a third-degree disability and a 60% loss of working capacity. The claimant argued that the illness caused significant moral suffering, including disruption of normal life, inability to maintain usual activities, prolonged treatment, and constant physical pain, anxiety, and a sense of insecurity.
According to a certificate from the Medical and Social Expert Commission dated 8 April 2020, the claimant was repeatedly and permanently assigned a 60% loss of working capacity.
The court ruled:
- To partially satisfy the claim.
- To award UAH 200,000 in moral damages without deductions for taxes or mandatory payments.
