China: Supreme People's Court publishes guiding cases to provide guidance on adjudication of ecological and environmental cases

"Is the construction project causing harm to public interests? Supreme Court Releases Guiding Cases on Ecological Environmental Protection Topics" CENEWS, May 28, 2025

On May 28, the Supreme People's Court publicly released the 46th batch of guiding cases on ecological environmental protection topics (Guiding Cases No. 257-261) in Chongqing to further strengthen the guidelines for adjudication rules on environmental resources trials.

It is reported that the five guiding cases are environmental civil public interest litigation cases, covering various types of cases, including environmental impact assessment of construction projects, prevention and control of radioactive pollution, solid waste pollution, tailing storage facilities pollution, and the severe punishment of illegal sand mining in the Yangtze River basin. The cases clarify three rules: one is the rules for ecological environment tort liability adjudication; the second is the rules for review in environmental public interest litigation cases; the third is the procedural rules for cases involving multiple administrative regions.
