台湾:科技公司移民工人虽缴纳劳健保和税金 却因制度漏洞无法留台就医

近日卫福部桃园医院的院内群聚感染,引发国内疫情再起疑虑。另一方面,印尼疫情持续加剧,台湾自上月初起更暂停引进印尼籍移工来台,将视后续疫情状况决定重启时间;移工入境难,国内部分产业已面临缺工。

但本刊调查,移工来源限缩下,一些在台工作的移工虽依法缴纳劳健保及税金,却因制度漏洞,一旦感染肺结核等传染病且雇主不同意其留在台湾治疗,就会被废止聘雇许可遭遣返,劳动部统计去年就有180例,甚至包括和硕集团子公司景硕、台积电供应链之一的泓格科技等科技大厂,近期也爆出类似个案,求助无门的移工只好转向立委陈情,更惊动和硕高层介入协调。

这些移工生病却要被无情遣返的个案,凸显法令的不完备。根据《就业服务法》和《受聘雇外国人健康检查管理办法》,移工若确诊肺结核或汉生病等,须在收到诊断证明书次日的15天内向各地卫生局申请「都治计画」,否则将被劳动部废止聘雇许可遭遣返,换言之,依法缴纳劳健保、税金的移工,须经雇主同意才可留台治疗。

何谓「都治计画」?根据卫福部资料,世界卫生组织强力推荐结核病个案均应实施都治计画(Directly Observed Treatment Short-Course, DOTS),藉由观察员「送药到手、服药入口、吞下再走」,每周至少执行5日以上的关怀服药,关怀结核病个案服药治疗过程,确保每一个病人规则服下每一颗药,以提高防治绩效,减少抗药性结核病人的产生。

依现行规定,确诊肺结核必须申请都治计画才可留台治疗,在雇主同意前,移工虽可看病,医生基于公卫风险也会暂时开药给他们治疗,但最后若无法拿到雇主同意书,他们旋即就会被劳动部废聘而遭遣返回母国,无法真正在台湾治疗到痊愈。
