联合国工商业与人权工作组报告:“有效的补救机制应切合权利持有人的不同经验和期望”

联合国人权与跨国公司和其他工商企业问题工作组在报告中对《工商企业与人权:实施联合国“保护、尊重和补救”框架指导原则》中关于获得有效补救的概念进行解析。它澄清了有效补救权、获得有效补救、获得司法救助和企业责任之间的相互关系。它从权利持有人的角度审视有效补救的问题,并提出,补救机制应切合权利持有人的不同经验和期望。受影响的权利持有人应能在不用惧怕受到伤害的情况下,寻求“多种形式的补救”。
