Poland publishes National Action Plan on Business and Human Rights

Poland released its draft NAP (in Polish) on 15 December 2016 and the Council of Ministers adopted the plan on 29 May 2017. An English version of the NAP is available below.

Operationalizing the UN Guiding Principles on Business & Human Rights: Polish & Italian steps to adopt National Action Plans

The main aim of the article is to critically assess Polish draft and Italian NAP... Even if some criticism [is] raised, it should not overshadow the general positive perception of the actions taken by governments, who are eager to commit and support human rights obligations of business. Our criticism of NAPs, of its imperfect structure and contents, does not mean that the principles of the UNGP will not be observed, or that those actions are preordained to be ineffective. What is of the greatest importance is its application and attitude of the state to fulfil it...

Our analysis reveals the overall tendency of Polish and Italian governments to reach mainly for voluntary solutions, instead of trying to balance them with legally binding measures as recommended by the UNWG. Time will show to what extent and how effectively both governments will promote their non-binding proposals... Nevertheless, it is essential to avoid the vagueness which characterises both documents analyzed in this article... [I]t is important to [...] cooperate with civic society organizations which [...] demand clear answers and model solutions, [...] but also constantly push the limits and put the government under pressure to improve and engage more.

Polish National Action Plan for the Implementation of the United Nations Guiding Principles on Business and Human Rights 2017-2020

...The fundamental issue in conducting business activity is to act in accordance with the applicable regulations of civil, criminal, and administrative law; the provisions on conducting economic activity; the Labour Code; environmental standards; industry regulations, etc. The principles included in the second pillar of the UN Guidelines on Business and Human Rights refer to corporate responsibility for respecting human rights. This responsibility also covers the idea of corporate social responsibility (CSR). As defined by the European Commission in 2011 this involves the responsibility on the part of businesses for their impact on society. This impact has a multidimensional nature and is manifested not only in terms of how companies care for the environment, their employees, and working conditions. The impact that companies have on the world is also evident in conducting business on the basis of similar values; taking into account people in production, distribution, and consumption processes; and implementing social responsibility in all areas of a company’s operations...

Draft Polish National Action Plan on Business and Human Rights

Ministerstwo Spraw Zagranicznych, we współpracy z wybranymi ministerstwami i instytucjami, w tym przede wszystkim z Ministerstwem Rozwoju, Ministerstwem Rodziny, Pracy i Polityki Społecznej, Ministerstwem Skarbu Państwa oraz Ministerstwem Sprawiedliwości, prowadzi prace nad przygotowaniem Krajowego Planu Działania dotyczącego wdrożenia Wytycznych ONZ w zakresie biznesu i praw człowieka.

[Only available in Polish] W dniu 27 marca br. ponad 30 organizacji wystosowało apel do Pani Prezes Rady Ministrów, Ewy Kopacz, o podjęcie przez Rząd Rzeczypospolitej Polskiej działań mających na celu wypracowanie Krajowego Planu Działań w zakresie biznesu i praw człowieka, zgodnego z Wytycznymi ONZ dotyczącymi biznesu i praw człowieka, przyjętymi jednogłośnie w czerwcu 2011 r. rezolucją Rady Praw Człowieka ONZ nr A/HRC/17/4.
