A York County scrapyard was sued Monday for allegedly violating the state’s Clean Streams Law and federal Clean Water and Resource Conservation and Recovery Acts.

J&K Salvage ... is alleged to have continuously discharged pollutants into Codorus Creek despite not being authorized to, the lawsuit filed in the Middle District of Pennsylvania alleges...

A permit that allows the discharge of certain materials in accordance with limitations and other requirements was granted to J&K as part of the Clean Water Act’s National Pollutant Protection. The permit expired November 2024, and despite that, the lawsuit states, J&K continued to discharge pollutants.

The lawsuit comes after a 90-day notice from the LSRA regarding intentions of filing a suit...

“Discharging pollutants to a waterway is illegal without a permit for a reason. Heavy metals such as Lead and Arsenic, chemicals like Boron, and cancer-causing contaminants known as PFAS or “forever chemicals” cause irreversible damage to humans and fish and do not belong in our public water resources.”

LSRA is asking for J&K to bring its facility into compliance with federal and state laws, including ceasing any discharging without a permit and illegal polluting...
