Alegaciones

[Summary translation prepared by Business & Human Rights Resource Centre]

Decision No. 122449393, dated October 14, 2024, Inhuletskyi District Court of Kryvyi Rih

The plaintiff worked at the defendant’s enterprise for an extended period, during which he developed chronic occupational diseases. According to the MSEC examination, he was determined to have a 65% permanent loss of professional capacity (50% due to radiculopathy, 15% due to siderosilicosis) and was assigned a third-degree disability.

As a result of the health damage, his usual way of life was disrupted. He suffers from constant pain, cannot pursue his usual activities and desires, and experiences ongoing anxiety about his health and life, which causes him significant emotional distress. Therefore, he requested UAH 400,000 in moral damages.

The Inhuletskyi District Court of Kryvyi Rih partially satisfied the claim.

It ordered PJSC Inhuletskyi Mining and Processing Plant to pay UAH 300,000 in moral damages to the plaintiff, without deductions for personal income tax or other mandatory payments.
