Ukraine: Sukha Balka to pay former worker UAH 300,000 in moral damages caused by loss of work capacity due to workplace accident

On 2 April 2024, the plaintiff’s legal representative, lawyer Pohoriletska A.V., filed a lawsuit against Private Joint-Stock Company Sukha Balka (hereinafter Sukha Balka).

The plaintiff had been employed at Sukha Balka from 3 June 2014 to 16 January 2024.
On 22 September 2023, at around 2:20 AM, while performing his duties as a mine roof bolter, the plaintiff suffered a workplace accident that led to significant injury and long-term health issues.

As a result, during an initial Medical-Social Expert Commission (MSEC) evaluation in January 2024, he was determined to have a 65% loss of work capacity and was granted Group II disability. The plaintiff requested compensation of 520,000 UAH for moral damages due to the injury.

The court partially upheld the claim. Sukha Balka was ordered to pay 300,000 UAH in moral damages for the occupational injury, without deduction of taxes or mandatory payments.
