Tumandok People,… JRPM and… KTNC Watch… respectfully file this complaint concerning the implementation of the Jalaur River Multi-Purpose Project Stage II… The funds for the implementation of the Project came through a tied loan provided by the Export-Import Bank of Korea (KEXIM Bank) under the Economic Development Cooperation Fund (EDCF). ... The contractor and executor of the Project is the Korean firm Daewoo Engineering & Construction Co. (DAEWOO). ... [The Project] ... involves the construction of a mega-dam ... on the ancestral land of the Tumandok ... The Project has led to adverse environmental and social effects... [and] violations of the OECD Guidelines for Multinational Enterprises as well as human rights standards under International law... JRPM and its partner[s]… documented widespread and systematic human rights violations by Philippine security forces... [including]... Failure to comply with requirement of free, prior, and informed consent; Massive deployment of military and police…; Surveillance and profiling of Tumandok communities, especially their leaders and members of civil society organizations; Extrajudicial killings, arbitrary arrest and detention;… Environmental destruction; Loss of ancestral land… and Displacement of… Tumandok communities… Despite the negative impact of the Project… DAEWOO maintain their business relationship with the Philippine government… OECD Guidelines state that enterprises should avoid infringing on the human rights of others and address adverse… impacts, ... carry out human rights due diligence... and co-operate ... in the remediation of adverse human rights impacts... We call on the Korean NCP ... to direct Daewoo E&C to ... withdraw and discontinue all logistical support for JRMP II, in recognition of the serious and irreparable harm caused by the Project…
