In this case the Inter-American Commission on Human Rights (the Commission) has brought proceedings based on actions and omissions that were detrimental to the Kichwa People of Sarayaku and its members (the victims) by having allowed a private oil company to operate within their ancestral territory without consulting with them beforehand.
