Decision № 119102106, 16.05.2024, Zhovtovodskyi City Court of Dnipropetrovsk Oblast

On April 2, 2024, the Zhovti Vody City Court of Dnipropetrovsk Region received a claim from Person_1 against the State Enterprise Eastern Mining and Processing Plant seeking compensation for moral damages due to a health injury caused by an occupational disease.

The plaintiff stated that he had worked at the enterprise in various roles during different periods between 1991 and 2023, and was dismissed on December 20, 2023. Over the course of his employment, he developed a chronic occupational disease.

According to a Medical-Social Expert Commission certificate dated March 21, 2024, he was found to have a 60% loss of working capacity, including: 30% due to chronic obstructive pulmonary disease (COPD), 15% due to chronic kidney disease, 15% due to hearing loss. He was also assigned a permanent third disability group.

The court partially satisfied the plaintiff's claim and ruled to recover from the State Enterprise Eastern Mining and Processing Plant the amount of 120,000 UAH (Ukrainian Hryvnia) as compensation for moral damages, taking into account personal income tax deductions.
