Japan: Lawsuit against leading real estate Fuji Corp. over alleged distribution of documents containing racist expressions constituting hate speech; company comments compensation orders "unacceptable"

In 2015, a zainichi Korean (permanent ethnic Korean residents of Japan) woman filed a lawsuit against her employee Fuji Corporation and its chairman, seeking compensation for damages caused by the company's distribution of documents containing racist expressions. According to the woman, the company started to distribute those documents from around 2013, and they included attacking words against people from South Korea and China such as saying these individuals “should die”and that they were “liars”, “sneaky”, and “wild animals”.

In July 2020, the Osaka District Court ruled in favor of the woman, ordering the company and its chairman to pay compensation. However, the company did not stop the distribution, which made the woman appeal in November 2020.

In November 2021, the Osaka High Court ruled again in favour of the women, recognising the documents were consistent with inappropriate discriminatory words and actions as outlined in the hate speech elimination law. The High Court ordered the company to halt its distribution and pay added amount of compensation. To this, Fuji Corp. released a comment describing the judgment as "unacceptable." The comment also reveals the company's plan to appeal over the legitimacy of its distribution.
