China: Food delivery drivers complain of underpay, overwork and dangerous working conditions

While the food delivery industry are expanding in China, food delivery drivers' working conditions have come under the spotlight as they complain of underpay, overwork and dangerous working conditions. 

Some food delivery drivers said that they were forced to work under extreme weather conditions. According to China Labour Bulletin's work accident map, there were 12 cases of accidents of food delivery drivers in August alone and 33 strikes by food delivery drivers in the first half of 2019. 

Ele.me, owned by Alibaba, and Meituan, backed by Tencent, are the two leading food delivery companies in China. When reached for comment by the media, Meituan said in a statement that it "has made substantial effort to ensure the welfare and safety of delivery drivers in its network..." and "leverages advanced technologies to make deliveries safer for riders", while "Ele.me did not respond to multiple requests for comment".

China: Food delivery workers forced to work under adverse weather conditions reveal lack of regulations

The dreadful working conditions of Chinese food delivery drivers returned to the spotlight in August, as many workers reported that they were forced to take orders during a tropical storm, when demand for food delivery surged.

One Ele.me motorist said all drivers had been threatened by management with a penalty if they refused a dispatch when being called back to work in extreme weather…

Another driver in Shanghai died electrocuted in a storm on 10 August while trying to go across a large puddle of water with his motorcycle… CLB’s work accident map documented 11 cases of accidents in August, in which 3 workers died and 8 were injured.

… Drivers are considered merely as ‘independent contractors’ when demands about pension and work injury insurance arise and yet cannot refuse to work in bad weather. Being ‘independent contractors’ do not bring them the right to choose whether to work or not, and they are moreover forced to keep on accepting deliveries because of fines and intense exploitation.

Alongside work accidents, four protests related to food delivery drivers were also recorded on CLB’s Strike Map, denouncing mainly low pay and wage arrear...

Regulations on the new platform economy are obviously lacking. In this new and yet fast-growing sector, labour relations between companies and workers are unclear as most drivers only complete simple procedures on the app. Problems related to income calculation, pay scale and work injury insurance are major areas where disputes arise.

Governments in other countries have already started to address some of these issues…

… Most food delivery drivers are without any labour contract in China and existing laws are inadequate to handle issues like fake distance calculation and concealed penalties. As protests and strikes of drivers continue to erupt in all major cities in China, it is high time for the official trade union to step in and help workers hold bargaining meetings with the platforms. [Also referred to Meituan]

China: Food delivery workers complain about underpay, overwork and dangerous working conditions

Underpaid and overworked, drivers for food delivery apps like Meituan and Ele.me are speaking out about brutal hours and dangerous conditions…

In China, the [food delivery] industry boom has been catalyzed by low delivery fees, aggressive marketing strategies, and a fleet of over 3 million drivers who are increasingly accustomed to poor safety conditions, decreasing wages, and fewer guarantees of consistent work.

In the first half of 2019, the Hong Kong–based China Labour Bulletin, which tracks labor movements in China, recorded 33 strikes by food delivery drivers, compared to 48 in all of 2018 and just eight in 2017, according to researcher Aiden Chau…

Aside from unannounced wage cuts, striking workers also reported being assigned impossibly short delivery times, leading to more road accidents involving delivery drivers. Independent contractors face liability should they get into a collision–and according to multiple drivers, they are docked pay, or suspended by the platform, if even a single order is late…

Ele.me, owned by tech giant Alibaba, and the Tencent-backed Meituan are already locked in a vicious price war to conquer the lion’s share of China’s roaring food delivery market. The companies… combine for a whopping 90 percent market share…  

These strategies have allowed China’s food delivery industry to grow three times larger than that of the United States, while keeping its delivery costs at around 10 to 20 percent of US standards—aided in large part by millions of low-wage workers, most of whom are hired as independent contractors and do not receive social benefits…

… food delivery is especially dangerous in China: Drivers for Meituan and Ele.me generally make less than $1 per order and break traffic rules to deliver them all on time… in Shanghai, 76 injuries and deaths of drivers had been recorded by police in the first half of 2017.

… Last summer, striking Meituan drivers complained that delivery times had been shortened and that the app’s built-in map assigned unsafe routes by showing distances far shorter than those shown by other online maps.”…

When reached for comment, Meituan said in a statement that it “has created millions of jobs” in China and “has made substantial effort to ensure the welfare and safety of delivery drivers in its network,” including providing periodic safety training and making it mandatory for drivers to be insured. Meituan also said it “leverages advanced technologies to make deliveries safer for riders,” such as smart scooters and headsets.
