In the morning, the Chair and State representatives met for a private meeting. The afternoon session started at 4pm Geneva time and the Chair announced the adoption of the draft report.

  • The Chair communicated that comments on the draft report are due by 14 November 2022 so as to ensure the publication of the final report by March 2023.
  • There were no comments from State representatives on the report and its conclusions and recommendations. Therefore, the report, including its conclusions and recommendations, were adopted.
  • The Chair adjourned the meeting by thanking stakeholders who were active in the process and stressed that NGOs’ proposed texts had been recorded.

    States and Civil Society Organisations commented on numerous articles of the Third Revised Draft: Articles 4 (Rights of Victims), 5 (Protection of Victims) and 14 (Consistency with International Law principles and instruments), as well as Articles 15-24. Negotiations closed for the 8th session at the conclusion of the morning.

    The session opened with a clarification from the Chair on the negotiation process, followed by statements from stakeholders on Articles 9 (Adjudicative Jurisdiction), 10 (Statute of Limitations), 11 (Applicable Law), and 12 (Mutual Legal Assistance and International Judicial Cooperation).  In the afternoon, States, CSOs and business and employer organisations then commented on Article 13 (International Cooperation) and the Preamble to the Third Revised Draft. Several States also provided statements on Articles 1 – 3 (Definitions, Purpose, and Scope).

    States and civil society organisations (CSOs) delivered their statements on Article 6 on Prevention, which outlines the state duty to regulate due diligence obligations for companies. In the afternoon, States, CSOs and business and employers’ organisations then commented on Article 7 (Access to Remedy) and Article 8 (Legal Liability) of the Legally Binding Instrument (LBI).
