Federal jury finds CVS Pharmacy in Anniston violated Age Discrimination Employment Act; awards pharmacist $400,000 (updated) [USA]

A federal jury today awarded a pharmacist $400,000 in back pay after finding a CVS pharmacy in Anniston had violated federal law when it fired the pharmacist when he turned 65…The jury returned a verdict stating that CVS had willfully violated the law - the Age Discrimination Employment Act - when it fired Harris in August 2009…The person replacing Harris at the pharmacy was 27 years old, [the plaintiff’s attorney] said…"We respect and appreciate the jury's effort in reviewing this case, but we strongly disagree with their decision," Mike DeAngelis, director of CVS Caremark Public Relations, stated in an email. "CVS Caremark has a firm non-discrimination policy, and we do not tolerate discrimination in our workplace on the basis of age or any other legally-protected trait. We are considering our options for appeal."…
