Investment policy: state duty to protect human rights

The time is right to focus attention on what states should be doing to implement their duty to protect human rights (DtP) in the context of investment policymaking...[M]omentum is growing worldwide for meaningful reform of investment policy at the domestic and international levels, and the world has embraced a new agenda on sustainable development...Embedding the protection of human rights into the full range of state policies and practices that support, facilitate, promote and regulate FDI should therefore be a key consideration for states, when implementing their duty to protect human rights...Yet, the currently published NAPs, as well as the discussions about NAPs in several jurisdictions are notable because they either do not address the FDI context, or they do so only partially...Engaging in investment policy often also requires technical knowledge that may not be common among human rights experts...To help overcome some of these obstacles the LSE Investment & Human Rights Project has published the Guide to Implementing the UN Guiding Principles in Investment Policymaking.  The Guide...outlines six key issues related to FDI for states to consider, offers ideas for state measures for implementation and provides examples from current state practice...
