Peru: Demonstrators arrested for protesting against the pollution caused by Antamina, released by Court

"Court of second instance orders the release of detainees for protest in Huarmey against Antamina", December 7 2021

In the afternoon of this Tuesday, December 7, the Second Criminal Chamber of Appeals of Chimbote has revoked the preventive detention and ordered the immediate release of the five residents of Huarmey arrested a month ago, after the protests that occurred on November 1 in that port...

Angelo Andree Vilchez Cerna, Luis Rufino Guerrero Virhues, Rufino Juan Tarazona Vega, Adolfo Moreno Rojas and Jehiel Moreno Alejo had been arrested and transferred to prison, accused by the Public Ministry of having committed crimes of violence against the authority, by opposing the development of the functions of the members of the National Police

For Mr. Rommel, the events were unleashed when the police unjustifiably fired tear gas bombs at several hundred demonstrators protesting against the pollution caused by the Antamina mining company in the port of Huarmey. The police took advantage of the panic of the people due to the effects of the gases and arrested the people who failed to flee the place and against whom they subsequently made the accusations indicated.

The criminal action is interpreted by Red Muqui's lawyer, Rodrigo Lauracio more as an action of intimidation through criminal tools rather than the persecution of possible excesses that occurred during the protests.

From the Muqui Network we welcome this decision that conforms to the truth and justice, since the accusations of the Public Ministry were not accompanied by evidentiary means that link the five inhabitants with the commission of crimes. We must emphasize that everyone has the constitutional right to protest, to question any action of the State or private actors.
