Wiwa v. Shell

Ken Wiwa (hijo del fallecido activista ogoni Ken Saro-Wiwa ejecutado junto con Barinem Kiobel en 1995) instauró una demanda relacionada a la de señora Kiobel, pero con anterioridad, junto con otros miembros del MOSOP en 1996. La demanda Wiwa se presentó en contra de las mismas compañías acusadas en el caso Kiobel. Esta demanda alegaba que el gobierno militar nigeriano y las fuerzas de seguridad perpetraron violaciones a los derechos humanos, que incluían tortura y ejecuciones sumarias de miembros del MOSOP para así eliminar sus actividades, y además que Royal Dutch/Shell fue cómplice de dichos abusos. Los demandantes ganaron varios fallos de cuestiones preliminares, entre los que se incluyen algunas mociones por parte de los demandados para desestimar el caso.

A inicios de junio del año 2009, las partes anunciaron que habían llegado a un arregloextrajudicial con una indemnización de U$ 15.5 millones. El acuerdo proporciona compensación para los diez demandantes, y cubre una porción de los costos legales de los demandantes. Además, el arreglo también establece la Fiducia Kiisi (Kiisi Trust), cuyo objetivo es beneficiar al pueblo Ogoni. Esta fiducia será manejada por fideicomisarios independientes, y tiene como objetivo patrocinar iniciativas en la comunidad Ogoni, como por ejemplo educación, programas de género, alfabetización de adultos y apoyo a pequeñas empresas.
