Japan: Fukuoka high court rules "deemed working hours system" applicable to off-site work in overtime pay case

A woman in Kumamoto City filed a lawsuit against her former employer, supervising organisation for foreign technical intern trainees, seeking unpaid overtime wages and disputing in court whether the “deemed working hours system” could be applied to duties performed outside the workplace. The Fukuoka High Court recognised the applicability of the system but ordered the organisation to pay approximately 220,000 yen for work not covered by it.

The woman’s duties included providing on site guidance, and her working hours were not recorded with a time card. Instead, she reported her start and end times in daily work reports.
