For her part, the lawyer representing one of the communities stated: “Prior consultation, Your Honour, ensures that the opinion of Indigenous peoples is taken into account before the adoption of any decision that may affect them.”..

On the other hand, the defence of the Antapaccay company reiterated that the approval of an environmental impact study does not constitute an act subject to prior consultation, arguing that this instrument does not authorize the start of activities and that the responsibility for convening the consultation lies with the Ministry of Energy and Mines...
