Warning on the inadmissibility of violations of mandatory requirements No. 177-2025 dated 01 July 2025

The Ural Interregional Department of the Federal Service for Supervision of Natural Resources (hereinafter – the Department) received information from the Ministry of Industry, New Technologies and Natural Resources of the Chelyabinsk Region (letter dated 09 June 2025 No. VKh-10431) regarding the failure of the water user, JSC “Karabashmed” (TIN 7406002523), under the decision on granting the use of a water body (Karabash Reservoir on the Serebryanka River) No. 74-14.01.05.008-P-DRBV-S-2022-16838/00 dated 19 October 2022, to submit a report on compliance with the conditions for use of the water body for the 1st quarter of 2025.

These actions (or inaction), namely the failure to submit the report on compliance with the conditions for use of the water body for the 1st quarter of 2025, may lead to / are leading to violations of the following mandatory requirements:

Clause 5, Part 2, Article 39 of the Water Code of the Russian Federation (03 June 2006 No. 74-FZ):

Owners of water bodies and water users, when using water bodies, are required to maintain records in the prescribed manner of the volume of water withdrawal (abstraction) from water bodies and the volume of wastewater discharge (including drainage waters), their quality, to conduct regular monitoring of water bodies and their protection zones, and to submit the results of such records and monitoring free of charge and within the established time limits to the federal executive authority authorized by the Government of the Russian Federation.

Clause 6, Part 2, Article 39 of the Water Code of the Russian Federation (03 June 2006 No. 74-FZ):

I hereby issue a warning and propose the following:

The Joint-Stock Company “Karabashmed” shall implement measures to ensure compliance with the mandatory requirements of the environmental legislation of the Russian Federation, including:

maintaining proper records of water withdrawal (abstraction) from water bodies;

conducting regular monitoring of water bodies and their protection zones;
