日本:【マタハラ】妊娠・出産・復職後 1年以内に降格は「違法」 厚労省

妊娠や出産を理由にした嫌がらせであるマタニティーハラスメントをめぐり、厚生労働省は30日、妊娠や出産、復職などから1年以内の降格や契約打ち切りなどの不利益な取り扱いは、原則として男女雇用機会均等法などに違反すると判断することを決め、公表した。マタハラをめぐる指導が厳しくなることで、企業は対策を迫られそうだ。

企業はたとえ「本人の能力が低い」などの理由をつけても、妊娠や出産、復職から1年以内は、社員にとって不利益な取り扱いは違法とされる。妊娠前から能力不足について指摘がされ、機会もあったのに改善の見込みがない場合などを例外として示した。

今回の決定のきっかけは、昨年10月の最高裁判決だ。妊娠中に負担の少ない業務に移ったことをきっかけに降格させることは原則違法だとした。
