The Paris Court of Appeal has upheld NGO actions against TotalEnergies and EDF, allowing for a detailed examination of their due diligence plans, which could lead to significant changes in their management of due diligence obligations.
“In the climate litigation brought against TotalEnergies by a coalition of associations and local authorities, the pre-trial judge of the Paris judicial court has ruled that the action was inadmissible. Based on a worrying interpretation of the law on duty of vigilance and the provisions on ecological damage, this decision restricts access to justice for associations and local authorities.”
The court found the coalition's arguments surronding mandatory targets under the Paris Agreement 'legally inadmissible.' The court also denied the coalition's request to issue a temporary injunction on new oil and gas projects.
NGOs and local authorities want the court to institute measures requiring TotalEnergies to suspend its new oil and gas projects and implement measures to reduce its emissions in order to conform with the Paris Agreement.

In February 2021, the tribunal ruled in favour of the NGOs and 14 local authorities by confirming its jurisdiction in the climate change litigation against Total. The company argued for the case to be heard before the commercial court.
