Takkom Jerry & LSD vs. Nykomb Synergetics Development AB

Takkom Jerry and Lumiere Synergie Developpement (LSD) filed a complaint to the Swedish NCP against Nykomb Synergetics Development AB, a Stockholmbased company that offers process and power systems, engineering consultancy and project development services. The complainants allege that Nykomb breached the OECD Guidelines by not taking significant measures to avoid potential negative impacts of the implementation of a coal-fired power plant, for not engaging sufficiently with the local communities whose livelihoods have been put at risk and for acting upon an outdated environmental and social impact assessment (ESIA) from 2009. According to the complainants Nykomb has not taken sufficient measures to avoid negative impacts on the sea, water and air quality identified in the ESIA. In terms of social and human rights issues, the complainants allege Nykomb has not engaged meaningfully with local communities. Thereby, community members who have already been impacted by the project and have been resettled have not been compensated and the project will furthermore block access to an elementary school, two cultural heritage sites and a cemetery. The complainants request the Swedish NCP to facilitate a dialogue aimed at bringing Nykombs behaviour in line with the OECD Guidelines. When a mediated solution proves not to be possible, the complainants request the NCP to examine the facts of the case to determine whether Nykoms behaviour has or has not been in line with the OECD Guidelines. Given the scale and severity of the impacts of the project as it is currently planned, the complainants suggest that Nykomb relocates its power plant.
